Section 3.12, Watershed Overlay District. <br />Purpose of Change: To comply with the North Carolina <br />Environmental Management Commission (EMC) adopted statewide <br />watershed regulations. <br /> <br />The Planning and Zoning Commission voted 9-0 to approve this <br />zoning text amendment. <br /> <br /> Mr. Jonathan Marshall, Planner, reviewed the proposed amendments to the <br />Watershed Overlay District regulations. He noted that the amendments will be <br />forwarded to the Environmental Management Commission for review after enactment <br />by the Board. There was lengthy discussion by Board members relative to the two- <br />acre minimum lot size and the restrictions placed on property owners in the <br />Watershed Overlay District. <br /> <br /> Chairman Carpenter opened the public hearing for Petition 92-03(t) at 7:55 <br />P.M. She asked if anyone were present who wished to speak for or against the <br />proposed amendment. There was no one present to address the Board, and Chairman <br />Carpenter closed the public hearing. <br /> <br /> UPON MOTION of Commissioner Payne, seconded by Commissioner Barnhart and <br />unanimously carried, the Board deferred action on Petition 92-93(t)~ Section <br />3.12, Watershed Overlay District, until the second meeting in January. <br /> <br />Western Area Plan <br /> <br /> Mr. Marshall reviewed the proposed Western Area Plan which had been jointly <br />prepared by the Planning staffs for the County and the City of Concord. The plan <br />is an analysis of the existing conditions in the area, the major issues affecting <br />the future to the area, and residents' goals for the future. It was noted that <br />the Planning and Zoning Commission voted 9 0 to approve the Plan. <br /> <br /> Chairman Carpenter opened the public hearing regarding the proposed Western <br />Area Plan at 8:10 P.M. and asked if anyone were present who wished to speak <br />either for or against the proposed plan. <br /> <br /> Mr. Curt Needham, representing a major landowner in the area, stated his <br />support of the proposed Plan. He commended the Planning staff and the Planning <br />and Zoning Commission for their work with the landowners in that area. Mr. <br />Needham asked the Board to petition the North Carolina Department of <br />Transportation to make the Westside By-Pass centerline alignment in the Crisco <br />Road area as soon as possible. <br /> <br /> There was no one else present to address the Board, and Chairman Carpenter <br />closed the public hearing at 8:14 P.M. <br /> <br /> UPON MOTION of Commissioner Barnhart, seconded by Commissioner Casper and <br />unanimously carried, the Board approved the Western Area Plan as prepared by <br />Planning staffs of Cabarrus County and the City of Concord. The boundaries of the <br />area are: to the north, N.C. 73 W (Davidson Highway); to the west and southwest, <br />the Mecklenburg/Cabarrus line; to the south and southeast, the Harrisburg <br />extraterritorial jurisdiction, Township Two boundary, and N.C. 49; and to the <br />northeast and north, U.S. 601 Bypass, U.S. 29, and Irish Buffalo Creek. The <br />Western Area Plan is on file in the Office of the County Manager. <br /> <br /> The Board by consensus, and in conjunction with the approval of the Western <br />Area Plan, asked the County Manager to draft a letter for the Chairman to send <br />to the North Carolina Department of Transportation asking that the Department <br />position the centerline of the Westside By-Pass as soon as possible to facilitate <br />planning in the area of the proposed By-Pass. <br /> <br /> <br />
