Simmons, Jr., Chairman <br />Cabarrus County Board of Commissioners <br /> <br /> UPON MOTION of Commissioner Payne, seconded by Commissioner Hamby with <br />Commissioners Payne, Hamby, and Carpenter and Chairman Simmons voting for, the <br />Board authorized the Chairman to sign the Public School Building Capital Fund <br />application requesting the release of $380,000.00 by the State for the following <br />Cabarrus County Schools project: <br /> <br />Odell Elementary Classrooms: Addition of a new classroom wing which <br />will contain ten new classrooms. <br /> <br /> UPON MOTION of Commissioner Payne, seconded by Commissioner Hamby with <br />Commissioners Payne, Hamby and Carpenter and Chairman Simmons voting for, the <br />Board ratified the execution of the following Lease between Mr. and Mrs. Thomas <br />A. Joyner and Cabarrus County to finalize the transfer of a portion of the <br />Ambulance Station No. 2 property located at the intersection of Highways 601 and <br />49 to Mr. and Mrs. Joyner. <br /> <br />NORTH CAROLINA <br />CABARRUS COUNTY <br /> <br /> THIS LEASE, executed as of the 31st day of December, 1990, <br />between THOMAS F. JOYNER and wife JUDY G. JOYNER, whose mailing <br />address is 112 Flowe's Store Road, Concord, North Carolina 28025 <br />(hereinafter called "Landlord"), and CABARRUS COUNTY, NORTH <br />CAROLINA, whose mailing address is P. O. Box 707, Concord, North <br />Carolina 28026-0707 (hereinafter called "Tenant"); <br /> <br />W I T N E S S E T H: that -- <br /> <br /> In consideration of the mutual covenants and agreements <br />hereinafter set forth, the Landlord does hereby lease and demise <br />unto the Tenant and the Tenant hereby accepts and leases from the <br />Landlord, for the term hereinafter specified, the real property <br />described in Exhibit A attached hereto and incorporated herein by <br />reference (hereinafter sometimes referred to as the "Demised <br />Premises"). <br /> <br /> TO HAVEAND TO HOLD the Demised Premises upon those conditions <br />and with those privileges set forth herein for the term herein set <br />forth, subject to the following covenants and conditions: <br /> <br /> 1. Term. The tenancy hereby demised shall commence on the <br />date hereof, shall continue until Tenant shall have abandoned the <br />Ambulance Station which it occupies adjacent to the Demised Premises <br />or four (4) years from the date of this Lease, whichever occurs <br />first. <br /> <br /> 2. Rental. The Tenant shall pay to the Landlord as rental <br />for the Demised Premises the sum of One Dollar ($1.00) per annum. <br />Such rental shall be paid in advance to Landlord, before Tenant <br />shall take possession of the Demised Premises for the initial term <br />or any renewal term. <br /> <br /> 3. Liability Insurance. Tenant shall carry at its expense <br />public liability insurance on the Demised Premises. <br /> <br /> 4. Quiet Enjoyment. The landlord covenants, warrants and <br />represents that it has full power and right to execute and perform <br />this lease and that the Tenant, upon paying the rent herein reserved <br />and performing the covenants and agreements hereof, shall peaceably <br />and quietly have, hold and enjoy the Demised Premises and all rights <br />and privileges belonging or in any way appertaining thereto, during <br />the full term of this lease or any extension thereof. <br /> <br /> 5. Use of Demised Premises The Demised Premises shall be <br />used exclusively for public purpose programs and activities. <br /> <br /> <br />
