6O <br /> <br /> 6. Notices. Ail notices required to be given hereunder by <br />either party shall be in writing and sent by registered or certified <br />mail, and all rentals mailed addressed to the parties at the <br />addresses set forth herein, and shall be deemed effective upon <br />deposit in the United States mail, postage prepaid. <br /> <br /> 7. Short Form. Upon the commencement of his lease and the <br />request of the other party, both the Landlord and the Tenant shall <br />execute a short form lease sufficient to be recorded under the laws <br />of the State of North Carolina. <br /> <br /> 8. Hold-Over by Tenant. In the event Tenant shall hold the <br />Demised Premises after the expiration of the term hereof with the <br />consent of the landlord, express or implied, such holding over <br />shall, in the absence of written agreement to the contrary, be <br />deemed to have created a tenancy from year to year terminable on <br />thirty (30) days written notice by either party to the other, upon <br />an annual rental basis and otherwise subject to all of the terms and <br />provisions of this lease. <br /> <br /> 9. Benefits. This lease agreement shall be binding upon <br />and shall inure to the benefit of the parties hereto and their <br />respective successors and assigns and shall not be amended except <br />by instrument in writing signed by the party to be charged. <br /> <br /> IN TESTIMONY WHEREOF, Landlord and Tenant have duly executed <br />this Lease the day and year first above written. <br /> <br />ATTEST: <br />/s/ Frankie F. Simmons, Jr, <br /> Chairman, Board of Commissioners <br /> <br /> UPON MOTION of Commissioner Payne, seconded by Commissioner Hamby with <br />Commissioners Payne, Hamby and Carpenter and Chairman Simmons voting for, the <br />Board authorized the County Manager to execute the Right of Way Encroachment <br />Agreement between Gabarrus County and the North Carolina Department of <br />Transportation for the following secondary road additions: Quail Hollow Drive, <br />Jon-Chris Drive and Deer Drive. <br /> <br />UNFINISHED BUSINESS <br /> <br /> The Board received the correspondence from Mr. Jonathan B. Marshall of the <br />Planning and Zoning Department requesting that consideration of the Northwestern <br />Small Area Plan be deferred until the next meeting in order for him to again <br />contact the City of Kannapolis relative to their comments concerning the plan. <br />The Board by consensus deferred the adoption of the Plan until Mr. Marshall has <br />received comments from the City of Kannapolis. <br /> UPON MOTION of Chairman Simmons, seconded by Commissioner Carpenter with <br />Chairman Simmons and Commissioners Carpenter, Hamby, and Payne voting for, the <br />Board finalized the transfer of the Expanded Food and Nutrition Education <br />Program equipment held by the Gabarrus County Agricultural Extension Service to <br />Mecklenburg County. The ten-day notice of the proposed transfer had been <br />published and no objections were received. <br /> UPON MOTION of Commissioner Hamby, seconded by Commissioner Carpenter with <br />Commissioners Hamby, Carpenter, and Payne and Chairman Simmons voting for, the <br />Board approved the appointment of the following members to a "Committee to Plan <br />for Human Services in Cabarrus County for the 21st Century" and asked that the <br />committee elect a chairman from its members. The terms for each member will <br />expire upon completion of the committee's task. <br /> <br /> <br />
