Small <br /> <br />Clerk <br /> <br /> RESOLUTION FOR THE <br />ASSURANCE OF AVAILABILITY OF MATCH <br /> <br />State of North Carolina <br />County of Cabarrus <br /> <br /> WHEREAS, at the March 4, 1991 meeting of the Cabarrus Board <br />of County Commissioners, a motion was made and duly seconded that <br />the Cabarrus County agrees to the following: In the event a Land <br />and Water Conservation Fund grant is awarded by the Department of <br />Environment, Health and Natural Resources, the Cabarrus County <br />certifies and assures that it has the ability and intention to <br />finance its 50% share of the total project cost of $100,000. <br /> <br /> Cabarrus County <br /> By: /s/ Billy J. Simmons, Jr. <br />Chairman, Cabarrus Board of County Commissioners <br /> <br /> Mr. W. E. Cochran, Jr., Engineer, reported that the Afton Run Project, <br />which included the outfall, pump station and force main, is now in operation. <br />He requested approval of Change Order No. 1 in the amount of $69,028.53 to the <br />original contract of $849,701.00 with Ramey, Inc. to cover the variations <br />between the Actual Contract Cost and the Estimated Base Bid and to authorize the <br />final payment to the Contractor. Mr. Cochran noted that the final payment would <br />be subject to the withholding of a sufficient amount to cover the pavement <br />repair on Interstate 85, resurfacing on North Carolina 73, and the seeding and <br />mulching repair work along the outfall. <br /> UPON MOTION of Commissioner Payne, seconded by Chairman Simmons with <br />Commissioners Payne, Carpenter, and Hamby and Chairman Simmons voting for, the <br />Board approved Change Order No. 1 in the amount of $69,028.53 to the contract <br />with Ramey, Inc. for the Afton Run Sewer Project and authorized the final <br />payment to the contractor subject to the following conditions. <br /> <br />Receipt of approval from the North Carolina Department of <br />Transportation on all work other than that listed below: <br />a. Withholding $5,000.00 for repairs made to 1-85 by North <br /> Carolina Department of Transportation forces and as yet <br /> unbtlled. <br />b. Withholding $2,100.00 for paving required by North <br /> Carolina ~epartment of Transportation on North Carolina <br /> 73, which will be done as soon as the weather is <br /> suitable. <br /> Receipt of request for final payment and all closing documents <br /> from the Contractor. <br /> Withholding $5,700.00 for repair of seeding and mulching <br /> damage by October flooding. Repairs cannot be made until <br /> spring. <br /> <br />The change order as approved was as follows: <br /> <br /> <br />
