138 <br /> <br /> Chairman Simmons announced the following settlement between Cabarrus <br />County and Watty and Bobbie Newsome. <br /> <br />RELEASE OF ALL CLAIMS <br /> <br />FOR AND IN CONSIDERATION OF the payment to me/us of the sum of Six <br />Hundred Dollars ($600.00) and other good and valuable consideration, <br />I/we, being of lawful age, have released and discharged, and by <br />these presents do for myself/ourselves, my/our heirs, executors, <br />administrators and assigns, release, acquit and forever discharge <br />Cabarrus County, the Cabarrus County Health Department, Chris Pope <br />and any and all other persons, firms and corporations, whether <br />herein named or referred to or not, of and from any and all actions, <br />causes of action, claims, demands, damages, costs, loss of services, <br />expenses, compensation, and all consequential damage on account of, <br />or in any way growing out of, any and all known and unknown <br />injuries, wrongful death and/or property damage resulting or to <br />result from the accidental and/or unintentional euthanistic <br />elimination of a Rottweiller dog named "Katie" on or about the 30th <br />day of August, 1990. <br /> <br /> I/we understand that this settlement is the compromise of a <br />doubtful and disputed claim, and the payment is not to be construed <br />as an admission of liability on the part of the persons, firms and <br />corporations hereby released by whom liability is expressly denied. <br /> <br /> This release contains the ENTIRE AGREEMENT between the parties <br />hereto, and the terms of this release are contractual and not a mere <br />recital. <br /> <br /> I/we further state that I/we have carefully read the foregoing <br />release and know the contents thereof, and I/we sign the same as <br />my/our own free act. <br /> <br /> WITNESS my/our hand(s) and seal(s) this 7th day of January, <br />1991. <br /> <br />CAUTION! Newton, Planning and Zoning Director, reviewed the two <br />proposed resolutions relative to the endorsement of projects to be included in <br />the Transportation Improvement Program. He noted that the resolution approved <br />by the City of Concord and the City of Kannapolis contained an endorsement of <br />the proposed extension of North Carolina 136 from Corban Avenue/Highway 73 east <br />to South Union Street/Highway 601 Business (project U-530) and the extension <br />from Wilshire Avenue to the proposed North Carolina 136 extension. <br /> UPON MOTION of Commissioner Barnhart, seconded by Chairman Simmons and <br />unanimously carried, the Board adopted the following Resolution. <br /> <br />A RESOLUTION REQUESTING THE INCLUSION OF NEEDED TRANSPORTATION <br /> PROJECTS IN THE TRANSPORTATION IMPROVEMENT PROGRAM OF <br /> THE NORTH CAROLINA BOARD OF TRANSPORTATION <br /> <br /> WHEREAS, Cabarrus County and its municipalities continue to <br />experience rapid growth of a residential, commercial, and industrial <br />nature; and <br /> <br /> WHEREAS, existing transportation facilities are becoming <br />increasingly inadequate in providing an acceptable level of service; <br />and <br /> <br /> WHEREAS, the Cabarrus County Board of Commissioners wish to <br />provide all citizens in Cabarrus County with continued acceptable <br />transportation in this area; <br /> <br /> <br />
