138 Chairman Simmons announced the following settlement between Cabarrus County and Watty and Bobbie Newsome. RELEASE OF ALL CLAIMS FOR AND IN CONSIDERATION OF the payment to me/us of the sum of Six Hundred Dollars ($600.00) and other good and valuable consideration, I/we, being of lawful age, have released and discharged, and by these presents do for myself/ourselves, my/our heirs, executors, administrators and assigns, release, acquit and forever discharge Cabarrus County, the Cabarrus County Health Department, Chris Pope and any and all other persons, firms and corporations, whether herein named or referred to or not, of and from any and all actions, causes of action, claims, demands, damages, costs, loss of services, expenses, compensation, and all consequential damage on account of, or in any way growing out of, any and all known and unknown injuries, wrongful death and/or property damage resulting or to result from the accidental and/or unintentional euthanistic elimination of a Rottweiller dog named "Katie" on or about the 30th day of August, 1990. I/we understand that this settlement is the compromise of a doubtful and disputed claim, and the payment is not to be construed as an admission of liability on the part of the persons, firms and corporations hereby released by whom liability is expressly denied. This release contains the ENTIRE AGREEMENT between the parties hereto, and the terms of this release are contractual and not a mere recital. I/we further state that I/we have carefully read the foregoing release and know the contents thereof, and I/we sign the same as my/our own free act. Mr. Gerald A. Newton, Planning and Zoning Director, reviewed the two proposed resolutions relative to the endorsement of projects to be included in the Transportation Improvement Program. He noted that the resolution approved by the City of Concord and the City of Kannapolis contained an endorsement of the proposed extension of North Carolina 136 from Corban Avenue/Highway 73 east to South Union Street/Highway 601 Business (project U-530) and the extension from Wilshire Avenue to the proposed North Carolina 136 extension. UPON MOTION of Commissioner Barnhart, seconded by Chairman Simmons and unanimously carried, the Board adopted the following Resolution. A RESOLUTION REQUESTING THE INCLUSION OF NEEDED TRANSPORTATION PROJECTS IN THE TRANSPORTATION IMPROVEMENT PROGRAM OF THE NORTH CAROLINA BOARD OF TRANSPORTATION WHEREAS, Cabarrus County and its municipalities continue to experience rapid growth of a residential, commercial, and industrial nature; and WHEREAS, existing transportation facilities are becoming increasingly inadequate in providing an acceptable level of service; and WHEREAS, the Cabarrus County Board of Commissioners wish to provide all citizens in Cabarrus County with continued acceptable transportation in this area;
