174 <br /> <br />That the Board of Commissioners designate the Child <br />Victimization Council as the community child protection team. <br />That the Board of Commissioners, rather than appointing a <br />chairperson at this point, permit this responsibility to be <br />carried initially by Mr. James F. Cook, Jr., as Director of <br />Social Services as provided by the Executive Order. <br />That during an initial period of about 90 days the Child <br />Victimization Council organize and develop procedures required <br />for it (or a designated sub-committee of itself) to serve in <br />the capacity of community child protection team. <br />That at the conclusion of this initial period, the Child <br />Victimization Council provide to the Board of Commissioners <br />a report on its progress together with recommendations <br />regarding the appointment of a chairperson who would serve for <br />some designated period and the appointment of additional <br />members should the Board wish to make such appointments. <br /> <br /> In regards to the appointment of additional members, Mr. Cook pointed out <br />that the North Carolina Association of County Commissioners is investigating the <br />liability questions relative to non-staff members serving in such a capacity. <br />Commissioner Barnhart requested a follow-up report in 30 to 60 days by Mr. Cook. <br /> UPON MOTION of Commissioner Barnhart, seconded by Commissioner Carpenter <br />and unanimously carried, the Board adopted the revised Frank Liske Park <br />Ordinance as recommended with the addition of the following provision to the <br />last sentence: "and repeals all prior ordinances in conflict therewith." The <br />Ordinance as approved is as follows: <br /> <br /> AN ORDINANCE REGULATING <br />THE USE OF THE FRANK LISKE PARK <br /> <br /> WHEREAS making available recreational opportunities for citizens of all <br />ages is a subject of general interest and concern, the Board of Commissioners <br />for the County of Cabarrus therefore declares that the public good and general <br />welfare of the citizens of this county require adequate and safe recreational <br />facilities and it is the policy of this county to encourage, foster, and provide <br />these facilities for all of its citizens and to preserve and protect the public <br />safety, peace, health, comfort, enjoyment, and welfare of all persons while <br />within the limits of Frank Liske Park. <br /> Be it ordained by the Board of Commissioners for the County of Cabarrus <br />that the following rules and regulations for the use of and conduct on the <br />county property known as Frank Liske Park shall apply to all those who use, <br />visit, or enter Frank Liske Park. <br /> <br />Section 1. Construction. <br /> In the interpretation of this and all succeeding Cabarrus County Parks and <br /> Recreation Department regulations or ordinances, the provisions shall be <br /> construed as follows: <br /> 1. Any term in the singular shall include the plural. <br /> 2. Any term in the masculine shall include the feminine and neuter. <br /> 3. Any requirement or prohibitions of any act, shall respectively <br /> extend to and include the causing and procuring, directly or indirectly, <br /> of such act. <br /> 4. No provision hereof shall make unlawful any act necessarily <br /> performed by any officer or employee of the department or county in line <br /> of duty or work as such, or by any person, his agent or employees, in the <br /> proper and necessary execution of the terms of any agreement with the <br /> department or county. <br /> 5. Any act otherwise prohibited by law or local ordinance shall be <br /> lawful if performed, under, by virtue of, and strictly within the <br /> provisions of a permit so to do, and to the extent authorized thereby. <br /> 6. These regulations are in addition to and supplement the State <br /> Vehicle and Traffic Laws which are in force and which are incorporated <br /> herein and made a part thereof. <br /> <br />Section 2 Definitions. <br /> In the interpretation of this and all succeeding Cabarrus County Parks and <br /> Recreation regulations or ordinances, the following terms, unless <br /> otherwise defined therein, shall mean the following: <br /> 1. "Department": Gabarrus County Parks and Recreation Department. <br /> <br /> <br />
