230 <br /> <br /> 2. Some of the additional annexed areas are in the portion <br /> of the County presently within the boundaries of the Pitts VFD fire <br /> tax district; and <br /> 3. The County currently contracts with Pitts VFD for fire <br /> service throughout the Pitts VFD fire tax district, and for that <br /> service a fire service tax has been levied upon the Pitts VFD fire <br /> tax district; and <br /> 4. Because of the annexations, the area and tax base which <br /> will remain within the Pitts VFD fire tax district will decrease to <br /> a point where continuing the fire service of the Pitts VFD will soon <br />become impracticable; <br /> 5. The County has a need for a location for an emergency <br /> services facility, and Concord has a need for a location for a fire <br /> station to serve the incorporated areas of the community. <br /> NOW THEREFORE <br /> The parties have hereby agreed, based upon mutual <br /> consideration, the receipt and sufficiency of which is admitted and <br /> acknowledged by all the parties, entered into this Agreement, with <br /> terms and conditions as follows: <br /> 1. Purpose. The purpose of this Agreement is to (a) <br /> facilitate the dissolution of the Pitts Volunteer Fire Department, <br /> Inc.; (b) provide for fire protection in those areas now served by <br /> the Pitts Volunteer Fire Department, Inc.; and (c) provide Concord <br /> and the County with facilities for expanded fire, ambulance and law <br /> enforcement service to those areas now served by Pitts Volunteer <br /> Fire Department, Inc. <br /> 2. Spec!al Legislation. The parties will support special <br /> local legislation in the General Assembly to permit the <br /> unincorporated areas of the Pitts VFD fire tax district which lie <br /> to the north of Interstate 85 to become a part of the Odell VFD fire <br /> tax district. <br /> 3. Fire Protection Service. Concord will, by contract with the <br /> County, provide fire protection service to those areas which are <br /> presently 1) in the Pitts VFD fire tax district, 2) south of <br /> Interstate 85, and 3) not yet incorporated into any municipality, <br /> along with providing such back-up fire protection service to other <br /> areas as was provided by Pitts VFD under its contract with the <br /> County for fire protection service. <br /> 4. Compensation. Concord will charge the County the sum of <br /> One Dollar ($1.00) per year for up to ninety-nine (99) years as <br /> compensation for providing the fire protection service set forth <br /> herein. <br /> 5. Property Conveyance. Pitts VFD will dissolve as a <br /> corporate entity and shall convey, at no charge, all of its real <br /> estate, its building, and its rolling stock (except for the Suburban <br /> vehicle used as a First Responder unit), its computer, and the <br /> equipment stored on the rolling stock (except for the Suburban) to <br /> Concord. <br /> 6. Specific Property. The Suburban shall be given to Concord <br /> specifically for use as a First Responder unit vehicle, and <br /> specifically for use in the general area of the present Pitts VFD <br /> fire tax district. If the vehicle is not used by Concord as a First <br /> Responder unit vehicle within the general area of the Pitts VFD fire <br /> tax district, then Concord agrees that the vehicle will become the <br /> property of the Cabarrus Rescue squad. <br /> 7. Future Disposition. As the vehicles covered in Paragraph <br /> 4 to be given to Concord under this Agreement are replaced and no <br /> longer needed by Concord for fire protection, Concord agrees to <br /> donate each individual vehicle to the volunteer fire department <br /> within Cabarrus County with the smallest tax base which has not <br /> previously received such surplus vehicles from Concord under this <br /> Agreement. <br /> 8. Community Gatherings. The real estate and building <br /> conveyed to Concord shall remain reasonably available for use as a <br /> site for community gatherings and meetings. Such meetings shall <br /> include, but shall not be limited to, such meetings as Lions Club, <br /> Community Associations, EMS training, and other civic and community <br /> groups. <br /> 9. Operating Agreement. Although the real estate and <br /> building shall be conveyed to Concord, Cabarrus County shall also <br /> <br /> <br />
