310 <br /> <br /> UPON MOTION of Chairman Simmons, seconded by Commissioner Barnhart with <br />Commissioners Barnhart, Carpenter, and Hamby and Chairman Simmons voting for, <br />the Board authorized a contribution in the amount of $1,992.00 to the Civic <br />Education Project sponsored by the North Carolina City-County Management <br />Association, the North Carolina Association of County Commissioners and the <br />North Carolina League of Municipalities. The County's share of $1,992.00 was <br />based on the formula of five cents per capita requested from all counties and <br />cities/towns in North Carolina. <br /> Chairman Simmons stated that this was the date and hour for a public <br />hearing on the proposed Zoning Text Amendments as recommended by the Gabarrus <br />County Planning Board. Mr. Gerald Newton, Director of Planning, Zoning, and <br />Building Inspections, presented each of the proposed amendments to the Board. <br /> <br />(1) <br /> <br />Petition 91-02(t). 10.15 Vesting of Development Rights. The <br />Planning and Zoning Commission voted 9-0 to approve this <br />zoning text amendment. <br /> <br /> There was no one present to speak either for or against Petition 91- <br />02(t), and Chairman Simmons closed the public hearing. <br /> UPON MOTION of Commissioner Barnhart, seconded by Commissioner Carpenter <br />with Commissioners Barnhart, Carpenter, and Hamby and Chairman Simmons voting <br />for, the Board approved Petition 91-02(t) as follows: <br /> <br />Section Number and Name: 10.15 Vesting of Development Rights <br />PURPOSE OF CHANGE: <br />A developer/owner may establish a vested right to complete a <br />development project by making a formal request to the Planning and <br />Zoning Commission. The request shall contain: <br />1. A description with reasonable certainty, the type and <br /> intensity of a use for a specified parcel(s) of land. <br />2. "Site Specific Plan" or "Phased Development Plan" which shall <br /> be in the form of a subdivision plat drawn in accordance with <br /> the Cabarrus County Subdivision Regulations or a site <br /> development plan drawn in accordance with Section 5.4 and <br /> Section 5.5 of this ordinance. <br />Upon receiving a request for vested rights, the Planning and Zoning <br />Commission shall hold a public hearing to review the submitted <br />plans. If the plans are approved, the vested rights shall run with <br />the land for a period of two (2) years, beginning from the date of <br />approval. <br />Any variations from the original plan must have the consent of the <br />Planning and Zoning Commission. <br /> <br />Cabarrus County Subdivision Regulations. Revision of Fee <br />Schedule. <br />The Planning and Zoning Commission voted 8-1 to approve this <br />revision. <br /> <br />No one spoke either for or against the proposed revision of the fee <br />schedule. <br /> UPON MOTION of Commissioner Barnhart, seconded by Chairman Simmons with <br />Commissioners Barnhart, Carpenter and Hamby and Chairman Simmons voting for, the <br />Board amended the Subdivision Regulations Fee Schedule to include a fee in the <br />amount of $10.00 per new lot created for staff review of a conveyance plat. <br /> UPON MOTION of Chairman Simmons, seconded by Commissioner Carpenter with <br />Chairman Simmons and Commissioners Carpenter, Hamby, and Barnhart voting for, <br />the Board approved the Contract Amendment for the Weatherization Assistance Plan <br />Agreement (Contract Number 91-1441-50A1) between the Energy Division, North <br />Carolina Department of Economic and Community Development, and the Gabarrus <br />County Department of Aging.
