566 <br /> <br /> UPON MOTION of Commissioner Hamby, seconded by Commissioner Melvin with <br />Commissioners Hamby, Melvin and Moss and Chairman Lentz voting for, the Board <br />approved the following "Amendment to Lease" with the State of North Carolina for <br />the Frank Liske Park property. <br /> <br />STATE OF NORTH CAROLINA <br />COUNTY OF CABARRUS <br /> <br />AMENDMENT TO LEASE <br /> <br /> THIS AMENDMENT TO LEASE, made and entered into this the <br />day of , 1990, by and between the STATE OF NORTH <br />CAROLINA, hereinafter referred to as Lessor, party of the first <br />part, and the COUNTY OF CABARRUS, hereinafter referred to as Lessee, <br />party of the second part; <br /> W I T N E S S E T H: <br /> THAT, WHEREAS, the parties entered into a Lease Agreement <br />dated September 19, 1979, covering 191.89 acres of the Stonewall <br />Jackson Training School lands, located in No. 11 Township, Cabarrus <br />County, North Carolina; and <br /> WHEREAS, the State of North Carolina, Department of Human <br />Resources, has requested and approved the execution of this lease <br />amendment for the purposes set forth herein; and <br /> WHEREAS, the execution of this instrument for and on behalf <br />of the State of North Carolina was approved by the Council of State <br />at a meeting held in the City of Raleigh, North Carolina, on the 2nd <br />day of October, 1990; and <br /> WHEREAS, the parties hereto have mutually agreed as herein set <br />forth; <br /> NOW, THEREFORE, in consideration of the premises and the <br />mutual covenants contained therein, the parties do hereby agree that <br />the Lease and Lease Amendment between the same parties dated <br />September 19, 1979, shall be and the same is hereby formally amended <br />as follows: <br /> <br /> 1. That commencing with the execution of this instrument the <br />Lessee is granted an option to renew the lease agreement for one (1) <br />additional twenty-five (25) year term, said 25 year term shall <br />expire on December 31, 2029. <br /> 2. Ail other terms and conditions of the Lease shall remain <br />the same as is and in full force and effect. <br /> IN TESTIMONY WHEREOF, this instrument has been duly executed <br />by the parties hereto, as of the date first above written. <br /> <br />ATTEST: <br />/s/ Frankie F.
