Davis <br />Senior Resident Superior Court Judge <br /> <br /> Judge Davis presented comments to the members of the Board of <br />Commissioners relative to their duties and responsibilities to all citizens of <br />Cabarrus County. <br /> There was a short recess after which time Commissioner Simmons reconvened <br />the meeting and turned it over to Mr. Ruffin for the organization of the Board. <br /> Mr. Ruffin called for nominations for Chairman of the Board. <br /> Commissioner Barnhart nominated Commissioner Simmons as Chairman. <br /> UPON MOTION of Commissioner Payne, seconded by Commissioner Hamby and <br />unanimously carried, nominations for Chairman were closed and Commissioner <br />Simmons was unanimously elected Chairman by acclamation. <br />Mr. Ruffin called for nominations for Vice-Chairman of the Board. <br />Commissioner Payne nominated Commissioner Barnhart as Vice-Chairman. <br />UPON MOTION of Commissioner Simmons, seconded by Commissioner Payne with <br />Commissioners Simmons, Payne, Barnhart and Hamby voting for and Commissioner <br />Carpenter voting against, nominations for Vice-Chairman were closed and <br />Commissioner Barnhart was elected Vice-Chairman by acclamation. <br /> Chairman Simmons presided over the remainder of the meeting. <br /> UPON MOTION of Commissioner Payne, seconded by Commissioner Barnhart and <br />unanimously carried, the minutes of November 19, 26, and 28, 1990 were approved <br />as written. <br /> UPON MOTION of Chairman Simmons, seconded by Commissioner Barnhart and <br />unanimously carried, the Board moved to suspend the Rules of Procedure in order <br />to add items to the prepared agenda. <br /> <br />NEW BUSINESS CONSENT <br /> <br /> UPON MOTION of Commissioner Hamby, seconded by Commissioner Carpenter and <br />unanimously carried, the Board approved the following "Transportation Contract <br />for Services" between the Safeway Cab Company and the Cabarrus County Department <br />of Aging. <br /> <br />TRANSPORTATION CONTRACT FOR SERVICES <br /> <br /> THIS AGREEMENT, entered into as of this 13th day of November, 1990 by and <br />between Safeway Cab Company hereinafter referred to as the "Vendor" and Cabarrus <br />County Department of Aging hereinafter referred to as the "Purchaser." <br /> <br />W I TN E S SETH THAT: <br /> <br /> WHEREAS, the Purchaser desires to engage the vendor to render services in <br />connection with the transportation program (hereinafter referred to as the <br />"Program"), for the older adults in Cabarrus County in the Purchaser's contract <br />with the North Carolina Department of Public Transportation designated for the <br />provision of transportation services through EHTAP funds. <br /> <br /> WHEREAS, the vendor is a licensed transportation service company with the <br />demonstrated capacity and desire to render transportation service to older <br />adults. <br /> <br /> NOW THEREFORE, in consideration of the premises and the mutual covenants <br />and agreements hereinafter contained, the parties hereto agree as follows: <br /> <br />Vendor agrees to sell and purchaser agrees to buy on a limited basis <br />transportation services for older adults in Kannapolis to the Royal Oaks <br />Nutrition site for this program according to the provisions of the <br />agreement. The vendor agrees not to sub-contract for the delivery of the <br />services called for in this agreement. <br /> <br /> <br />
