(Copy of the revised conservation easement language must be <br />attached hereto as an amendment to the NCDA&CS ADFPTF contract at time of <br />approval) <br />The Agency legal counsel and Farmland Preservation Director must approve additions, <br />omissions, or modifications of said template. The final "Conservation Easement' must <br />meet with Agency approval to remain eligible for funding. <br />4. The Grantee shall provide the Agency with the appropriate reimbursement request <br />(downloadable at www.ncadfo.ore) and required documentation of performance and <br />expenditures for associated grant reimbursement. The Agency shall make payments to the <br />Grantee on the following guidance: <br />a. No more than $25,000 if the grant award is $31,250 or greater and up to 80% of <br />the grant if the grant award is less than $31,250 prior to the recording of the <br />"Conservation Easement." <br />b. All payment requests must have documented purpose of use of grant funds and be <br />within the approved amounts designated in the contract grant budget. <br />c At the time of a properly recorded "Conservation Easement," the Agency shall <br />pay to the Grantee no more than 80% of the awarded grant amount. <br />d. The Agency shall decrease the contract award amount based on current <br />conservation easement appraisal, if applicable. <br />e. The Grantee shall ensure that 59.26 acres are placed under an agricultural <br />casement with no more than a 5% variance in recorded easement acreage without <br />prior written approval of the Agency. <br />f. The division of the funds used to purchase the agricultural easement from <br />matching resources and Agency resources must be maintained as noted in the <br />grant contract budget. The Grantee may request the Agency for an exception to <br />the division of funds if the Agency is the only entity providing easement funding. <br />g. The Agency easement purchase shall not exceed 50% of the easement value. If <br />the Agency is the only grantor of funds used to secure the conservation easement <br />recording, the Grantee may request in writing with sound reasoning for the <br />Agency payment to exceed 50% of the easement purchase value. <br />h. At no time shall the total payment of grant funding exceed the grant contract <br />value. <br />i. All grantee payments most have receipts of expenditures to verify use of funding <br />per contracted purposes. <br />Rev. 7/18 <br />F-7 Page 135 <br />
