April 16, 2018 (Regular Meeting) Page 3520 <br />Used Tires: Passenger car tires delivered by (No plastic or foam bags, <br />county residents will be accepted in loads of please.) <br />five (5) or less. Tires from commercial <br />establishments must be delivered to US Tire <br />Recycling on Poplar Tent Road consistent with <br />N.C., G.S. 130-A-309.58 <br />(F-6) Solid Waste Management - Scrap Tire Recycling and Disposal Contract With <br />US Tire Recycling <br />Pursuant to NCGS 130-A-309.58, Cabarrus County is required to <br />dispose/recycle used and scrap tires at a state approved disposal facility. US <br />Tire Recycling, located in Cabarrus County, meets the requirements as set out <br />by state regulations. The Solid Waste Department requests that US Tire Recycling <br />continue to be designated as the County's disposal facility for used and scrap <br />tires, and that the Board of Commissioners approve the renewal of the five (5) <br />year contract in the amount up to $1,125,000 ($225,000 per year). This service <br />is funded through a revenue distribution from the State Scrap Tire Tax Program <br />and is included in the FY 2018 - 2019 budget. <br />UPON MOTION of Commissioner Kiger, seconded by Commissioner Shue and <br />unanimously carried, the Board approved the designation of US Tire Recycling as <br />the County's disposal facility for used and scrap tires; including the renewal <br />of the five-year contract between Cabarrus County and US Tire Recycling for an <br />amount up to $1,125,000, subject to budget approval for FY 2019, 2020, 2021, <br />2022 and 2023; and authorized the County Manager to execute the contract on <br />behalf of the County, subject to review and/or revision by the County Attorney. <br />(F-7) Tax Administration - Refund and Release Reports - March 2018 <br />The Release Report contains taxpayers' names, bill numbers, valuations, <br />tax amounts, along with the justifications for releasing the valuation/tax <br />amounts for outstanding levies in accordance with N.C.G.S. 105-381. The Refund <br />Report is a summary sheet which lists data from each refund request form, along <br />with the justification for the refunds to the taxpayers in accordance with <br />N.C.G.S. 105-381. <br />Note: Due to the transition of motor vehicles onto the new North Carolina <br />Vehicle Tax System (NCVTS), motor vehicle -related refunds and releases will <br />begin to be displayed on the new report generated by NCVTS. <br />UPON MOTION of Commissioner Kiger, seconded by Commissioner Shue and <br />unanimously carried, the Board approved the March 2018 Refund and Release <br />Reports as submitted, including the NCVTS Refund Report, and granted authority <br />to the Tax Collector to process the refunds and releases. The report is hereby <br />incorporated into the minutes by reference and is on file with the Clerk to the <br />Board. <br />(G) NEW BUSINESS <br />(G-1) Planning and Development Department Proposed Text Amendment to <br />TEXT2018-00001 - Public Hearing 6:30 p.m. <br />On behalf of Susie Morris, Planning and Zoning Manager, Jonathan Marshall, <br />Deputy County Manager, presented proposed changes to the Cabarrus County <br />Development Ordinance. He stated, should the Board approve of these changes, a <br />change to the fee schedule will also be required. Mr. Marshall reviewed the <br />following proposed changes: <br />Chapter B, Conditional Uses #21 Reception Facilities <br />o Proposed change to correct typo related to handicapped parking <br />reference in Chapter 10. <br />Chapter 2, Rules of Construction and Definitions <br />o Add statutory reference to definition of Agriculture. <br />o Amend bona fide farm definition to reflect statutory change. A <br />Farm Identification Number is no longer acceptable to qualify as <br />a bona fide farm. <br />Chapter 7, Performance Based Standards, #68 Temporary Uses <br />o Remove references to events that include assembly <br />o Remove fireworks stand <br />o Amend Similar and Compatible Uses Not Specified to remove <br />language related to events that include assembly <br />o Amend temporary tent or other temporary structure use to include <br />cell on wheels (COWS) and clarify that intended use may initiate <br />review and approval by Emergency Management. <br />
