October 15, 2018 (Regular Meeting) Page 3728 <br />Clerk to the Board <br />Consistency Statement for Proposed Amendment to the Cabarrus County <br />Development Ordinance Chapter 16, Flood Damage Prevention <br />TEXT2018-00002 <br />Having reviewed and considered the Proposed Amendment TEXT2018-00002, the <br />accompanying documents, the staff analysis, Department of Public Safety input, <br />comments from the general public, and input from the Cabarrus County Planning <br />and Zoning Commission, the Cabarrus County Board of Commissioners adopts this <br />statement of consistency. <br />The Proposed Amendment is consistent with the Small Area Land Use Plans (Plans) <br />because the Plans seek to create a safe and healthy community, to preserve open <br />space, to create expanded housing options, and to encourage economic <br />development. <br />The Proposed Amendment is reasonable and in the public interest because Cabarrus <br />County participates in the National Flood Insurance Program (NFIP) and in the <br />Federal Emergency Management Agency (FEMA) Community Rating System (CRS) <br />Program. The proposed ordinance and the adoption of the FEMA Flood Rate <br />Insurance Maps (FIRM) allows regulation of development as it relates to the <br />Special Flood Hazard Areas (SFHA) identified for Cabarrus County by FEMA. Use <br />of the floodplain maps and the corresponding model ordinance provided by the <br />North Carolina Department of Public Safety when reviewing development results <br />in less damage to residences and businesses. It also creates a more resilient <br />community when flooding events occur. Participation in the NFIP program and <br />floodplain regulation also allows Cabarrus County to seek disaster relief <br />assistance when significant weather events cause flooding in Cabarrus County. <br />For the reasons set forth above, the Planning and Zoning Commission recommends <br />that the Cabarrus County Board of Commissioners consider adopting proposed text <br />amendment TEXT2018-00002. <br />For the reasons set forth above, the Cabarrus County Board of Commissioners <br />hereby adopt this Statement of Consistency and approve TEXT2018-00002. <br />Signed this 15th day of October, 2018. <br />/s/ Stephen M. TEXT2018-00003 <br />proposes amendments to Chapter 10 and Chapter 14. Chapter 10, Parking and <br />Loading, includes language related to interior access roads and the North <br />Carolina Fire Code requirements. Chapter 14, Nonconformities, allows additional <br />time for structures destroyed by natural causes to be rebuilt. Ms. Morris stated <br />TEXT2018-00004 proposes amendments to Chapter 2 and Chapter 7. Chapter 2, Rules <br />of Construction and Definitions, is in regard to accessory structure and <br />accessory dwelling unit. Chapter 7, Performance Based Standards, is in regard <br />to accessory structure standards and would allow additional flexibility. She <br />also responded to questions from the Board. <br />Chairman Morris opened the public hearing at 7:18 p.m. The Public Hearing <br />Notice was published in The Independent Tribune on October 3, 2018 and October <br />10, 2018. The Public Hearing Notice was also posted on the County's website <br />(www. cabarrus county. us) on October 2, 2018 in accordance with Article 2, <br />Administration, Section 2.1 (Use of Electronic Means to Provide Public Notices) <br />of the Cabarrus County Code of Ordinances. <br />There was no one present to address the Board; therefore, Chairman Morris <br />closed the public hearing. <br />Vice Chairman Honeycutt MOVED to adopt TEXT2018-00003, TEXT2018-00004, <br />amendments to Chapter 2, Chapter 7, Chapter 10, Chapter 14 and the Consistency <br />Statement. Commissioner Shue seconded the motion. <br />Following a brief discussion, the MOTION unanimously carried <br />Ordinance No. 2018-48 <br />
