He said Mr. Wong is here tonight,he testified at the <br />hearing, andsowe can adopt his testimony from the last hearing also. Mr. Wongconfirmed with <br />metoday and I have put this on the plan, that he has spoken with NCDNR,and no underground <br />detention is needed on this site because the impervious is less than 24 percent,so it isconsidered <br />low density by NCDNR. There would be no outstanding drainage questionof how that could <br />affect the development and orientation of uses and improvementsofthis site. <br />Those appear to be two of the main questionsthe Board had,and this chart is also on our plan. <br />Those aretwo major updates,in addition to the physical and layout updates to our planthat we <br />have. <br />He said with regard to the 200-foot setback,obviously would be very impressive to this property. <br />It would totally prohibit any new use or development of this property and so there really isnot <br />much else to say about that. The setback is very extreme if it is applied to this property. <br />With regard to the perimeter landscape buffers, what we focused on based uponcomments from <br />this Boardwas getting any of the accessory use structures out of the buffer.So, they are all gone, <br />there are no accessory use structures within the buffer. <br />(Shows the buffer on plan) <br />He said one of the unique things about this sitethatgoes to the hardships,isthatit has <br />nonparallel property lines,and even this property line slants injust a little bit onthe east <br />compared to the west.The rear property line slants in towards the building. So, the building was <br />built almost on a north,south, east, west, coordinatebut it does not line up with the rear property <br />line, and so the rear property line shifts in a little bit. By shifting the pool to the rear, we do not <br />have any issue with the poolactuallybeing in the buffer,but the pool deck area to give enough <br />space, a small portion of the pool deck area that is paved will be within that buffer area. <br />Then on the northeastern corner, to get the walking trail around the end of the parking, the buffer <br />juts out just a little bit more and so it is 23 feet in that area. It actually, kind of jogs out alittle bit <br />inthenortheasterncorner and thencomes back inas it goes true north.This area right here, why <br />you see a gap in the buffer, is because that is the cell tower easement.There would not be any <br />planting there because thathas to be kept open and provide access to the cell phone tower. Then <br />again, the walking trail has been shifted to the backof the planting buffer on the eastern side. <br />He said these encroachmentsinto the buffer are all paved. They are all at gradeand so <br />physically,there are no building structures within the buffer now,unlike inthe previous plan. <br />These are just at grade, paved areasfor walking. There ismaybe one or two parking spaces <br />maybe,in this northern area with theconnector to the cell towerand then a portion of the pool <br />deck. There would also be some fence, but the fence is really for safety purposes because the <br />fence surrounds the pool and outdoor areas which would be requiredby code to have fencing <br />aroundthe pool areas.So, with regard to the buffer reduction, it is all at grade paving areas, no <br />more structures. <br />15 <br /> <br />
