Planning and Zoning Commission <br />Minutes <br />October 11, 2022 <br />7.If a speaker has questions of a person on the other side, such questions shall be addressed <br />to the Commission members to be redirected to the person to be asked. There will be no <br />direct questioning of one speaker by another except through the Commission. <br />8. <br />Any other type of audible support shall be out of order and subjectthe offender to being <br />removed from thebuilding. Anyone speaking out of order shall likewise be subject to <br />removal. <br />9.These rules are designed to have a full and fair hearing that is orderly and expeditious and <br />avoid unnecessarily repetitious presentations. <br />Mr. Brent Rockett MOTIONED, SECONDEDby Mr. Stephen WisetoADOPTthe Rules of <br />Procedures. The vote was unanimous. <br />New Business Planning Board Function: <br />RZON2022-00004Request to rezoneproperty from Limited Commercial(LC) district to <br />CountrysideResidential(CR) District.Owners are Larry and Regina Lewis. Applicant is Jerry <br />Lewis. Address is 672 NC Highway 24/27 E.Midland, NC, (PIN:5534-38-9978). <br />The Chair asked if there were any Board membersthat have any conflicts of interest,or any <br />information related to the case that needs to be disclosed at this time. There being none, the <br />Chair called on Mr. Phillip Collins to present the Staff report. <br />Mr. Phillip Collins, Senior Planner addressed the Board presenting the Staff report for <br />RZON2022-00004.He pointed out that even though it states that the owner is Larry and Regina <br />Lewis, the property changed hands on October 4, 2022,and the owner is now Jerry Lewis. <br />The subject property is approximately .92 acresin size.Access to the property is currently <br />provided through a 60-foot right of way adjacent to the subject property.Two storage buildings <br />are located towards the rear of the property.The driveway for the residence on the adjoining <br />property to the east traverses the subject property. <br />The subject property is surrounded by vacant properties, agricultural,residential,and commercial <br />uses. Surrounding zoning consistsof propertieszoned Limited Commercial(LC), Countryside <br />Residential(CR),Midland Single-familyResidential(SFR). <br />Currently, the subject property is not served by public sewer.Public water is available, and the <br />applicant intends to tap on. <br />The Ordinance states that lands in the Countryside Residentialdistrict have a strong rural, <br />pastoral feel. Natural environmental elements suchastree lines, small ponds, rock formations, <br />and manmade elements such as pasture fencing are tobe retained, if possible. Although the area <br />is capable of handling higher densities ofdevelopment, development is kept at very lowoverall <br />densities.Development includes only thestandard single-familydetached dwelling. <br />2 <br /> <br />
