Planning and Zoning Commission <br />Minutes <br />October 11, 2022 <br />This land use district was created as a direct result of the County's systematic area planning <br />process. As a reaction to the growth of the past decade,many residents are anxious to see their <br />areas retain the appeal that inspired the resident tomake his or her original investment. The <br />district helps implement a growth managementphilosophy before the fact, rather than after. In <br />summary, the principalpurpose of this districtis to provide some land area in the County for a <br />permanent country, rural residential life style. <br />The subject property is located within the boundaries of the sPlanning Areafor <br />Midland.The Midland Area Land Use Plan (MALUP) recommends the subject property be <br />developed with limited commercial uses.The MALUP states that the Limited Commercial <br />district is reflective of the existing commercial uses in Midland.These areas shall be a variety of <br />commercial uses ranging in intensity and will not incorporate residential areas. Large-scale <br />commercial development in these areas should be considered carefully on a case-by-case basis. <br />The front portion of the site is currently vacant; however,as he stated before,the rear of the site <br />is occupied by two storage buildings. <br />According to aerial photo data, the front of the subject property has always been vacant, and the <br />two accessory buildings appear to have been placed on the subject property sometime between <br />2001 and 2005. <br />The rear portion of the subject property is zoned CR while the front portion of the subject <br />property is zoned LC.It has been zoned this way since 2003 when the rear portion of the lot <br />was zoned Low Density Residential (LDR). <br />In reference to this next sentence in the Staff report, he would like to clarify that the mapfrom <br />1987,was actually from the land use planat that time, so the entire property was recommended <br />for LowDensity Residential usesat that time,andnotactuallyzoned as such. <br />Currently, the front portion of the lot would be considered a conforming lot under the LC zoning <br />designation.However, if the entire lot were rezoned to CR, it would no longer be considered a <br />conforming lot as it is less than one acre in size and the minimum average lot width is less than <br />150 feet. <br />Rezoning the subject property would allow the property owner to construct a residence on the <br />property. <br />The applicant states in his application that the lot is too small to accommodate a commercial use <br />and that a commercial use is not consistent with the surrounding properties. <br />According to the historic zoning maps, the front portion of the subject property appears to have <br />been zoned LC since 1993.The rear portion of the subject property was zoned LDR until 2005 <br />when it was changed to CR.The LC zoning district does not permit single-familyresidential <br />uses. <br />3 <br /> <br />
