Planning and Zoning Commission <br />Minutes <br />October 11, 2022 <br />As stated earlier, there are two storage buildings located on the rear of the subject <br />property.There are no permits on file for the buildings; therefore, these structures are <br />considered non-conforming uses. Rezoning of the subject property to CR would allow the <br />property owner to construct a residence and permit the storage buildings as accessory uses <br />eliminatingthisnon-conforming feature of thesubject property. <br />The proposed rezoning request is inconsistent with the recommendations of the Midland Area <br />Land Use Plan for the subject property.However, single-familydetached residential uses are not <br />permitted within the Limited Commercial (LC) district and the applicant is proposing to <br />construct a residence on the property. <br />This is a conventional rezoning request; therefore, all uses permitted in the CR zoning district <br />would be allowed on the subject property if approved. The Planning and Zoning Commission <br />should consider all the information provided and determine if the proposed rezoning is consistent <br />with the Commission's vision for this area of Cabarrus County. <br />The Chair asked if there were any question for Mr. Collins. <br />Mr. Charles Paxton understands that Midland group is opposed to this rezoning. It is in the <br />unincorporated part of Cabarrus County, correct? <br />Mr. Collins said right. <br />Mr. Paxton said the front part they have a say so over? <br />Mr. Collins said no.The propertyis entirely underjust <br />askthe nearest town what their take is on the rezoning. <br />Mr. Paxton said,and theyareopposed toit? <br />Mr. Collins said yes,even though theLand Use Plan would be consistent with their Land Use <br />Plan. <br />Mr. Jeff Corley said it appears there aresomeneighboring residential usesthat are already within <br />this zoning district,are they nonconforming? <br />Mr. Collins said do you mean in the LC District? <br />Mr. Corley said yes. <br />Mr. Collins said yes, it would be nonconforming use if it is in the LC. <br />The Chair said if those property owners wanted to do somethingto those properties, they would <br />have to do the same thing? <br />4 <br /> <br />
