Planning and Zoning Commission <br />Minutes <br />October 11, 2022 <br />Mr. Collins said yes. <br />The Chair asked if there were any questions for Mr. Collins. There being none the Chair called <br />on the Applicant. <br />Mr. Jerry Lewis, Applicant, 1548 Mark Drive, Concord,NC,addressed the Board. He said all he <br />wants to do is build a house thereto live in it.Butthe neighbors are thinking that he is going to <br />build a house tosell it, which it does not matter, it is his property. He is building it to live in, not <br />to sell. <br />The Chair asked if anyone had any questions for Mr. Lewis. There being none,the Chair opened <br />the Public Hearing. He asked if there was any one speaking in favor of this rezoning. There were <br />none. He asked if there were anyone speaking against the rezoning. <br />Mr. Gary Barnhill, 676 Highway 24/27 East, Midland, NC,addressed the Board. He said it is a <br />very weirdlyshapedproperty. The story behind it is there was a family squabble. We bought the <br />propertythelooks kind of white there (on the diagram)a few years ago,assuming that we were <br />going to purchase this land at some point,because everyone we spoke to said nothing could <br />really be built there.Who was going to want to buy it other than me or one ofthe neighbors? <br />Itoriginally was a part of the property that we bought, but because of the family squabble,or <br />whatever, it does not really matter. <br />So now, his brothersold it to him. Mr. Barnhill spoke with Mr. Lewis and the area that hesays <br />he wants to build in, that he has staked off right now is only 45 feet onone side,and on the other <br />side about 75 or 80 feet. He does not seehow that would be possible unlesshe is going to stick a <br />trailer on it, even that,if the setback is 20 feeton each side and you have a five-foot trailer. <br />Aside from that,even if you builtthe housesomewhere else,lowerdown the hill,if that could <br />work outwith the sewerand everything else, then the back is rightinmy house. Then he wants <br />toput a garage in the backhe says. So, anytime he, the kids, and he just became a grandfather, <br />are in the backyard we aresurrounded by a house right on top of us, in the backalso surrounded. <br />Wemovedout there to have open land and be free. You areat leastprobably100 yards from <br />each neighboron each side. This is a nightmare for us, he understands things happen, itis not his <br />fault that theproperty was sold in that shape. Buthe does not see howit is possible for him to a <br />build a house and meet the parametershe has tofor one;it is a nightmare for him and his family. <br />The Chair asked if there were questions for the applicant or Staff. <br />Mr. Jeff Corley asked Mr. Collins what kind of setbacks would CR have on this property?Thisis <br />a weird shape. <br />Mr. Collins said it is, like he mentionedinhis report,it makes it a nonconforming zoning <br />designation. When a lot does not conform to a zoningdistrict,they are allowed to meet the MDR <br />setbacks,which arefive on the sides,25in the frontand 20 on the rear.
