He does not know if a survey has been done or anything <br />like that. <br />The Chair asked if we know if a septic permit has been applied for?The Chair askedMr. Lewis <br />ifhad applied for a septic permit. <br />Mr. Lewis said yes from the audience. <br />Mr. Paxton said just to repeat thatMr. Collins, you are saying it could be buildable? <br />Mr. Collins said it would appear that way. We would prefer they meet the CR setbacks if they <br />can,but because it is a nonconforming lot, if it is rezoned,MDR setbacks arenow in play. <br />Mr. Corley said help him understand the driveway situationhere. thereappears to be one <br />driveway going to house that kind of meanders,maybe evenoff this property we <br />are talking about. Has that been discussedwith you on how that will work? He asked Mr. <br />Barnhill to come back up. <br />Mr. Barnhill said what is your questionexactly? <br />Mr. Corley said, looking at the driveway it appears thatmaybe your driveway to your home kind <br />ofmeanders onto this property and then back to your home. Has this been discussed; that will be <br />resolved? <br />Mr. Barnhill said he does not know. We have discussed it and he (Mr. Lewis) was saying he <br />could just use the other driveway beside it, which there is another cut through. The neighborwho <br />owns most of the land behind me,he owns a strip of land right there to make sure he had access <br />back to his land and he is not happy with this,and he does not want his land being crossed. <br />Mr. Barnhill said essentially,a new drive is going to have to be built. Because minestarts at the <br />beginning,and if it comes to this,I will have to put one in and then he would have to build a new <br />one, which there is a tree line at the road, so there will have to be a new driveway put in through <br />there. <br />The Chair asked if there were any other questions. There being none,the Chair said the Board <br />needs to discuss the proposed request and come up with a motionto approve or deny the request. <br />We also need to establish findings in support of our decisioneither for or against. <br />Mr. Paxton said if he is not allowed to build a house, he agrees that there is not going to be any <br />commercial use.Therefore,there is going to be dead land,and he does not think that is fair to the <br />property owner. <br />TheChair said before we move on, we need to close the Public Hearing. <br />6 <br /> <br />
